Acceptance of Terms
By creating an account or using the CardVis mobile application and services ("CardVis" or the "Service"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legal agreement between you (the user) and CardVis. If you do not agree to any part of the Terms, you must not use the Service. Your use of CardVis is also subject to any applicable laws and regulations, as well as our Privacy Policy (which describes how we handle your data). By accepting these Terms, you confirm that you have read and understand them.
Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country) to use CardVis. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. You must also have the legal capacity to enter into this agreement. The Service is operated from the United States and intended primarily for users in the U.S. If you access CardVis from outside the U.S., you are responsible for compliance with any local laws. We do not represent that the Service is appropriate or available for use in all jurisdictions, and we may restrict access from certain countries as needed.
User Accounts
Account Registration: To access CardVis, you must create a user account. You can sign up using a valid email address or through a third-party login (such as "Sign in with Apple"). You agree to provide accurate, current, and complete information during registration and to update your account information as needed. You must not impersonate anyone or choose an account name that is offensive or violates someone's rights.
Account Security: You are responsible for maintaining the confidentiality of your account login credentials. Do not share your password or allow others to use your account. You agree to notify us immediately at support@cardvis.com if you suspect any unauthorized access to or use of your account. CardVis will not be liable for any loss or damage arising from your failure to safeguard your account information. You are responsible for all activities that occur under your account, whether or not you authorized them.
Account Use: Each user may create only one account, and accounts are for personal use only. You must not use another person's account or allow someone else to use yours. We reserve the right to suspend or terminate any account that we suspect is being used in violation of these Terms or for any fraudulent or inappropriate activity (see Termination below for more details).
Subscription and Payments
CardVis operates on a subscription-based model with grading credits:
- Subscription Plans: To use the grading features of CardVis, you must purchase a subscription. We offer weekly and monthly subscription plans ("Plan") which provide you with grading credits. Grading credits are units that allow you to submit a collectible card for AI grading (typically one credit per card, covering both front and back image analysis). Details of current plans, pricing, and the number of credits included per period are provided in the app's purchase interface. By subscribing, you authorize CardVis (or the app store platform) to charge you the subscription fee on a recurring basis until you cancel.
- Payment Processing: All payments for subscriptions are handled through the Apple App Store, Google Play Store, or other platform providers, depending on your device. This means CardVis does not directly collect or store your credit card or payment information – such information is handled securely by the platform's payment system. You agree to comply with your platform's applicable payment terms and policies when subscribing. You are responsible for any internet or mobile fees that may apply to your use of CardVis.
- Auto-Renewal: Subscriptions automatically renew at the end of each billing cycle (weekly or monthly, according to your Plan) and you will be charged in advance for each renewal term, unless you cancel. Your subscription will continue until canceled by you or terminated by us in accordance with these Terms. You must cancel at least 24 hours before the end of the current billing period to avoid being charged for the next period. Cancellation instructions can be found in the app store platform's subscription management settings (for example, via your Apple ID or Google Play account settings).
- Cancellation and Changes: If you cancel your subscription, you will continue to have access to your remaining grading credits and subscription benefits until the end of the current paid period. After that, you will lose access to features that require a subscription (though you will retain access to your account and any previously saved results). We do not provide refunds or credits for partial subscription periods or unused grading credits, except where required by law or at our sole discretion. If you believe extenuating circumstances merit a refund, you may contact us at support@cardvis.com, but we make no guarantee of refund outside legal obligations.
- Modification of Fees: CardVis reserves the right to change the subscription fees or introduce new charges for the Service. If we do so, we will provide advance notice to you (for example, by app notification or email). Fee changes will take effect at the start of your next subscription period following the notice. If you do not agree to a fee change, you must cancel your subscription before the new fees apply. By continuing to use the Service after the price change takes effect, you agree to the new price.
Grading Credits: Grading credits obtained through a subscription have no cash value and are not transferable. They are solely a measure of Service usage. Unused credits at the end of a billing cycle may expire depending on your Plan terms (the app will indicate if credits roll over or not). Credits cannot be exchanged for money or any other goods or services except the card grading Service offered by CardVis.
Card Image Uploads and Grading Results
CardVis allows you to submit images of your collectible trading cards for AI-based grading. By uploading or capturing photos within the app, you agree to the following:
- Permitted Content: You should only upload images of collectible cards that you own or have permission to use. Each grading submission typically requires clear images of both the front and back of the card. You must not upload images that are illegal, obscene, infringing, or unrelated to collectible cards. The quality of the grading results depends on the quality of the images; you are responsible for providing high-quality, focused images that show the entire card without obstructions.
- User Ownership and License: You retain ownership of the images of cards that you upload. CardVis does not claim ownership of your card images or your personal grading results. However, by uploading images to the Service, you grant CardVis a worldwide, royalty-free, non-exclusive license to host, store, transmit, display, and otherwise use those images solely for the purpose of providing the grading Service to you. This means we may process the images through our AI, generate grading reports, and store the images and results in your account. We will not use or share your images publicly without your permission (CardVis currently has no public galleries or social sharing features). If in the future we introduce community features (for example, the ability to share your graded card images or show them in a public profile), we will give you control over what content you choose to share.
- Grading Process and Results: Once an image of a card's front and back is uploaded, CardVis's AI will analyze the images and produce a grading report. The grading report typically includes a breakdown of key factors such as centering, edges, surface, and corners, along with an overall grade or score for the card's condition. These grading results will be displayed in the app and saved to your private in-app collection associated with your account. You acknowledge that AI grading is based on algorithms and image analysis; while we strive for accuracy and consistency, the results are ultimately an assessment by the AI and are for your personal informational purposes.
- Use of Results: The grading reports provided are for personal use. CardVis does not currently offer an in-app download or export function for the grading report. However, you may capture or screenshot the results on your device for your records or to share externally at your discretion. Any such screenshots or shared content should not be misrepresented as an official grading certification from any third-party grading company. CardVis grades are not recognized as official grades by any professional grading authority, and you agree not to present them as such. They are a tool for your own collection management, insight, or pre-grading evaluation.
- Prohibited Conduct with Content: You must not use the grading feature to analyze content that is not a collectible card (or similar trading card item), and you must not attempt to abuse the grading system (for example, by repeatedly submitting the same card images to game or tamper with the results). We may impose limits on the number of submissions or use other measures to ensure the Service is fair and not misused.
Data Storage and Deletion
CardVis takes the privacy and security of your uploaded images and grading data seriously. By using the Service, you acknowledge and agree that:
- Storage of Images and Data: The card images you upload and the corresponding grading results are stored on CardVis servers and associated with your user account. This allows you to access your past grading reports and maintain a personal in-app collection of graded cards. Your images and grading data are kept private and are not visible to other users (since CardVis currently has no social or sharing functionality). We will not share your personal data or uploaded content with third parties without your consent except as necessary to operate the Service (for example, cloud storage providers or analytics services bound by confidentiality, as detailed in our Privacy Policy). CardVis currently does not share user data with any third-party companies for their own use. We reserve the right to update our data handling practices in the future (for example, if we partner with a third party or introduce new features), but if we do, it will be in accordance with an updated Privacy Policy or Terms and, where required, we will notify you or obtain your consent.
- Data Retention: We will retain your uploaded card images and grading results on our servers until you delete them or request their deletion. You can remove individual items from your collection within the app (if supported), or you may request complete deletion of your account and all associated data by contacting us at support@cardvis.com. Upon such a request and any necessary verification, we will delete or anonymize your personal data (including images and results) within a reasonable timeframe. Please note that removed content may persist in backup copies for a short period, but will no longer be accessible through the app and will be purged from our active systems in accordance with our data retention policies.
- User Controls: It is your responsibility to maintain backup copies of any data you value. While your card images and grades are stored in the app, CardVis is not liable for any loss of data – we encourage you to keep your own copies of important images or to screenshot important results if needed. If you delete an image or grading result (or your entire account), you understand that this action is permanent and that we may not be able to recover the deleted data.
- Account Deletion: If you choose to delete your CardVis account, all personal data associated with your account (including your images, grading results, and any active subscription information) will be deleted or de-identified, except to the extent we are required to retain certain information for legal, compliance, or accounting reasons. After account deletion, you will no longer be able to access any of your grading reports or images through the Service.
Intellectual Property Rights
CardVis Intellectual Property: All content and materials provided through the CardVis Service (excluding your personal uploaded images), including but not limited to the mobile application itself, the AI algorithms and software, design elements, logos, graphics, text, and trademarks, are the property of CardVis or its licensors and are protected by copyright, trademark, patent, and other intellectual property laws. CardVis and the CardVis logo are trademarks/service marks of our company. We reserve all rights in and to our intellectual property. You are granted a limited, non-exclusive, non-transferable, revocable license to use CardVis and its content for personal, non-commercial use in accordance with these Terms. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or perform any of our intellectual property (including the software or any portion of the Service) unless expressly authorized by us in writing. Any unauthorized use of CardVis's intellectual property is strictly prohibited and may result in termination of your rights to use the Service (in addition to other legal remedies).
User Content License: As noted in Card Image Uploads and Grading Results, you retain ownership of the images and content you provide. You also own the results (grading reports) for your cards. By using the Service, you give CardVis the rights necessary to use your content to provide the Service (this is a license to process and store your images and data, not a transfer of ownership). Except for this limited license, CardVis claims no rights over your personal card images. You are free to use your own images and grading information outside the Service as you see fit (for example, sharing on social media or selling your cards) – just remember that the CardVis name and any of our trademarks should only be used in a factual, non-misleading way (e.g., saying "graded by CardVis AI" is fine, but you may not use our logo or claim an official endorsement).
Third-Party Rights: All trademarks, service marks, and names of third-party products (e.g., the names of trading card games, sports leagues, or card manufacturers) that appear within CardVis are the property of their respective owners. Such third-party marks or names might be referenced in the app to identify the card being graded (for example, identifying a card as a "Pokémon®" card or "NBA" card for categorization). CardVis is not affiliated with, sponsored by, or endorsed by any card manufacturers, trademark owners, or official grading companies such as Pokémon, Topps, Panini, PSA, Beckett, etc. Use of any third-party names or images in the Service is solely for the purpose of identifying your collectibles and providing the grading Service under principles of fair use.
Acceptable Use
When using CardVis, you agree to do so in a lawful and respectful manner. You must adhere to the following acceptable use guidelines. You will not:
- Illegal or Harmful Activities: Use the Service for any unlawful purpose or in violation of any local, state, national, or international law or regulation. This includes (but is not limited to) uploading any content that is illegal to possess or that violates export control laws. You also agree not to use CardVis to upload or transmit any content that is harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable (even if such content were related to a card, which is unlikely, but this covers all scenarios).
- Infringement of Rights: Upload any images or content to CardVis that you do not have the right to use. This means you will not upload material that infringes or misappropriates any third party's intellectual property rights or privacy/publicity rights. (For example, do not upload images of someone else's cards or copyrighted images that are not actually a photo of a card you own, and do not include any background imagery that you don't have rights to.)
- Interference and Misuse: Engage in any activity that interferes with or disrupts the normal functioning of the Service, the servers, or networks connected to the Service. You will not attempt to bypass any security or access controls of CardVis, and you will not introduce any malware, virus, Trojan horse, or other harmful code into the app. Additionally, you agree not to use any automated means (such as scripts, bots, or scrapers) to collect information from or through the Service, or to circumvent or exploit the grading credit system or any usage limits.
- Reverse Engineering and Abuse: Attempt to reverse engineer, decipher, decompile, or disassemble the software or algorithms used by CardVis. You will not misuse the AI grading system, such as by attempting to submit non-card images, repeatedly submitting the exact same card to manipulate results, or exploiting any bugs. If you discover a bug or error, you agree to report it to us and not to take advantage of it.
- Impersonation and False Information: Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity (including falsely claiming to represent CardVis). You will not use the Service to deceive others. For example, you must not pass off CardVis grading results as if they were provided by an established professional grading company, and you must not falsify or alter the results image to defraud anyone.
- No Commercial Resale or Exploitation: Use the Service for any commercial purpose not expressly approved by CardVis. The Service is for personal use; you may not resell the grading Service or credits, or use the output of CardVis in a competing grading service. If you are a business (such as a card dealer) looking to use CardVis at scale or commercially, please contact us for proper authorization – any unauthorized commercial use is a violation of these Terms.
Violating the above acceptable use provisions may result in suspension or termination of your account, and could also expose you to legal liability. CardVis reserves the right to investigate any suspected breaches of this section and to cooperate with law enforcement or other authorities in prosecuting users involved in unlawful activities. We also reserve the right (but assume no obligation) to monitor content submitted to the Service and to remove or disable access to any content that we deem to violate these Terms or law.
Changes to Service or Terms
Service Changes: CardVis is an evolving service. We reserve the right to modify, update, suspend, or discontinue any aspect of the Service at any time. This includes adding or removing features (for example, introducing new community or sharing features in the future, altering the AI algorithm, adjusting credit usage policies, or changing the user interface). We will endeavor to inform users of major changes (such as significant feature additions or removal of features) via in-app notification, website announcement, or email. However, some updates or changes (like bug fixes or minor improvements) may be deployed without specific notice. You acknowledge that the form and nature of the Service may change from time to time without prior notice to you, and that future versions of the app may be incompatible with certain devices or older versions.
Terms Changes: We may revise or update these Terms of Service from time to time. If we make a material change to the Terms, we will notify you by posting the updated Terms within the app or on our website and by updating the "Last Updated" date at the top. In some cases, for significant changes, we might also notify you via the email associated with your account or via an in-app alert. It is your responsibility to review any updated Terms. By continuing to use the Service after new Terms become effective, you agree to be bound by the revised Terms. If you do not agree to any updated Terms, you must stop using CardVis and (if applicable) cancel your subscription. We encourage you to periodically review the Terms and our policies to stay informed of any changes.
Termination
By You: You may stop using the CardVis Service at any time. You may also delete your account at any time by following the procedures in the app (if available) or by contacting us at support@cardvis.com with a request to delete your account. Terminating your account will remove your access to the Service features, and as noted in Data Storage and Deletion, your data will be removed according to our policies. Keep in mind that simply deleting the mobile app from your device does not automatically cancel your subscription or delete your account – you must cancel your subscription through the app store and request account deletion as described if you wish to fully terminate the service and avoid future charges.
By CardVis: We reserve the right to suspend or terminate your access to CardVis (including your subscription and account) at our sole discretion, with or without notice, if we reasonably believe that you have violated these Terms or are misusing the Service. For example, reasons for termination may include (but are not limited to) failure to pay subscription fees, fraudulent or illegal activity, uploading prohibited content, interfering with the Service, or any breach of the Acceptable Use rules or other provisions of these Terms. We may also terminate or suspend the Service in its entirety (in which case, we will provide as much advance notice to users as practicable).
Effect of Termination: Upon termination of your account for any reason, your right to access or use the Service will immediately cease. If we terminate your account due to a violation of these Terms, you will not be entitled to any refunds for subscriptions or unused credits, except where required by law. We also reserve the right to refuse service and prevent future account creation if an account was terminated for serious violations or abuse. If you have any outstanding subscription at the time of termination, we may deactivate it to prevent further charges. Any data you have not backed up may be permanently lost (except that we may retain certain information as required or permitted by law, or as outlined in Data Storage and Deletion).
Certain provisions of these Terms will survive termination of your account. These include (but are not limited to) provisions regarding Intellectual Property Rights, Disclaimers and Limitation of Liability, Indemnification (if applicable), Governing Law, and any other clauses that by their nature should survive. Termination does not relieve you of any obligation to pay any outstanding fees or costs owed to CardVis.
Disclaimers and Limitation of Liability
"As-Is" Service Disclaimer: CardVis is provided on an "as is" and "as available" basis. While we strive to offer the best possible service, we do not guarantee that the Service will be uninterrupted, error-free, or meet all of your expectations. Use of the Service is at your own risk. To the fullest extent permitted by applicable law, CardVis disclaims all warranties, express or implied, regarding the Service and your use of it. This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We specifically do not warrant the accuracy, reliability, or correctness of the grading results provided by our AI. No information or advice obtained by you from CardVis or through the Service shall create any warranty not expressly stated in these Terms.
No Guarantee of Results: You acknowledge that AI grading of cards is a subjective and probabilistic process. CardVis does not guarantee that any grading result or score you receive will be accepted by others or have any particular impact on the value of your card. The grading breakdowns (centering, edges, surface, corners) and scores are our best estimates and are provided for informational and entertainment purposes. They are not certified appraisals. CardVis is not responsible for any decisions you make or actions you take based on the grading results (for example, selling or purchasing cards based on CardVis grades, or submitting cards to professional graders).
Limitation of Liability: To the maximum extent permitted by law, in no event shall CardVis or its parent company, affiliates, officers, employees, agents, partners, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages whatsoever. This includes, without limitation, damages for lost profits, lost data, loss of goodwill, device damage, or other intangible losses arising out of or related to your use of or inability to use the Service, even if we have been advised of the possibility of such damages. In particular, CardVis will not be liable for:
- Any error or malfunction of the app or AI system, including any incorrect grading result or any decision made based on an incorrect result.
- Unauthorized access to or alterations of your transmissions or data (for example, if someone gains access to your account due to your failure to safeguard login information).
- Interruption or cessation of the Service, including any downtime or data loss.
- Any bugs, viruses, or harmful code that may be transmitted to or through our app by any third party.
- The actions or content of any third parties (since, at present, CardVis does not host third-party content beyond user uploads, this is more a precautionary note).
Cap on Liability: If, notwithstanding the other provisions of these Terms, CardVis is found to be liable to you for any damage or loss arising out of or in any way connected with your use of the Service or these Terms, CardVis's total cumulative liability shall in no event exceed the amount you have paid to CardVis for the Service in the three (3) months immediately preceding the event giving rise to the liability (or, if you have not paid CardVis for the use of any Service, the amount of US $50.00). Some jurisdictions do not allow the exclusion or limitation of certain damages or liabilities, so some of the above limitations may not apply to you. In such jurisdictions, CardVis's liability will be limited to the fullest extent permitted by law.
Basis of the Bargain: You agree that the disclaimers and limitations of liability in these Terms are a material basis for the agreement between you and CardVis, and that we would not be able to provide the Service on the same terms without these protections.
Governing Law
These Terms of Service and any dispute or claim arising out of or related to the Service or these Terms (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict of law principles. If you are a consumer residing outside of the United States, you may also be entitled to certain protections under the laws of your country of residence, which shall prevail in the event of a conflict with U.S. law in specific instances.
By using CardVis, you agree that any dispute that we are unable to resolve amicably shall be brought exclusively in the courts of the State of Delaware or in the federal courts located within Delaware, and you consent to the personal jurisdiction of those courts. We and you waive any objections to the venue of such courts, including objections based on inconvenience. Notwithstanding this, CardVis reserves the right to seek injunctive or other equitable relief in any court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of our intellectual property or other proprietary rights.
Note for International Users: Because the Service is primarily intended for U.S. users, we make no guarantee that these Terms or the use of the Service complies with the laws of any other country. If you are accessing the Service from a region with laws governing content, data protection, or other aspects that differ from U.S. laws, please be aware that you are transferring information (including personal data and content) to the United States. By using the Service, you consent to this transfer and to the application of U.S. law as specified in this section.
